Can Your Child Qualify for an EHCP? Here’s What You Need to Know

An EHCP is a legally binding document that outlines the education, health, and social care support a child or young person requires. This guide will walk you through the basics of EHCP eligibility, assessment, and steps to ensure your child receives the best possible support.


1. What is an EHCP?

An EHCP is designed for children and young people up to age 25 who need more support than is typically provided in mainstream education settings. The plan assesses a child’s unique needs and specifies how their school, health services, and other support systems can work together to help them reach their full potential.


2. Key Criteria for EHCP Eligibility

Not every child with SEN or disabilities qualifies for an EHCP. To be eligible, your child’s needs must meet certain thresholds. Here are the main criteria:

  • Special Educational Needs: The child must have SEN that significantly impacts their ability to learn, such as specific learning difficulties, emotional or behavioural issues, sensory or physical impairments, or conditions like autism and ADHD.

  • Insufficient Support Through SEN Provision: Schools provide support through their SEN provision, often called “SEN Support.” If this support does not sufficiently meet your child’s needs, an EHCP may be considered.

  • Long-Term Impact on Education, Health, or Social Development: The plan is for children whose needs are expected to continue beyond temporary or minimal interventions, requiring a more comprehensive and coordinated approach across multiple areas.


3. How to Start the EHCP Assessment Process

If you believe your child might qualify for an EHCP, here are the steps to start the process:

  1. Request an EHCP Needs Assessment: You can make this request through your local authority or through your child’s school. Schools and parents both have the right to request an assessment if they feel that current support isn’t meeting the child’s needs.

  2. Gather Supporting Evidence: Providing documentation of your child’s difficulties and how they impact their education is crucial. Include reports from teachers, doctors, or other professionals who work with your child.

  3. Prepare for the Assessment: The local authority will evaluate your request and decide whether to conduct a full assessment. This may involve meetings, observations, and input from a range of professionals.


4. What to Expect During the Assessment

The assessment process can take up to 20 weeks, during which various professionals will evaluate your child’s needs. These may include educational psychologists, occupational therapists, and health professionals. The process ensures that all aspects of your child’s requirements are considered, including educational, social, emotional, and physical needs.

If the assessment determines that an EHCP is appropriate, the local authority will draft the plan, detailing the support your child will receive. You’ll have the opportunity to review and make suggestions before it’s finalised.


5. Next Steps: What if Your Child Doesn’t Qualify?

If your child doesn’t qualify, it can be disappointing, but it doesn’t mean they’re without support. Schools are still required to provide SEN Support, and many children benefit from tailored interventions.
